Documented milestones
2010: HUD announced a $413,500 civil penalty and indemnification concerning 31 mortgages. 2013: a HUD agreement recorded a $66,500 payment and indemnification concerning 10 FHA loans without an admission of fault or liability. 2015: NYDFS and FDIC registers identify additional agreements. 2017: DOJ announced the $1.25 million civil resolution. 2018: NYDFS issued the cease-and-desist order.
Avoid adding unlike amounts
Penalties, indemnification commitments, settlements and insurance recoveries are not interchangeable. Do not total them as a single consumer refund fund. A payment to the government does not automatically establish compensation available to an individual borrower.
Find the record behind a headline
Check the exact respondent, publication date, signed agreement and whether the document states allegations, admissions, findings or a negotiated resolution. The individual guides in Related reading explain those distinctions for the major events.
